Clearpay Marketing Rules Update

Introduction


This page is designed to help you understand:


[1] The new marketing rules that all merchants must follow when promoting Clearpay to customers from 1st June 2023.


[2] The required changes you need to make in order to be compliant before 1st June 2023.


[3] Where you can access the resources to implement the necessary changes.


Failure to make the necessary changes or follow the new rules can be a criminal offence in the UK. 

What is changing?


We have updated the Clearpay UK Marketing Rules that apply to all merchants when promoting Clearpay on your websites and across your marketing channels. The key change is that you must now use only the assets we provide in the Marketing Resources Centre to promote Clearpay on your website or in your marketing, and must use these assets only as instructed. 

What do you need to do?


[Step 1] Understand the new marketing rules


Carefully read the new Clearpay UK Marketing Rules. This outlines exactly how you should promote Clearpay for each marketing channel and other appropriate touchpoints. This includes:


  • Integration Assets
  • Checkout Buttons
  • Logos
  • Website
  • Email
  • Social Media
  • FAQ Pages
  • How It Works Pages



[Step 2] Ensure you are using the appropriate assets and disclaimers for future promotions


You will need to start following the new instructions outlined in the Clearpay UK Marketing Rules and use the newly approved language, assets and disclaimers by 1st June 2023. These can all be found in the Marketing Resources Centre


This encompasses all marketing formats and channels - including those in the non paid-for space. If you have any ongoing ads running that mention Clearpay, you must update these to comply with the new rules by 1st June 2023.



[Step 3] Replace existing integration and marketing assets


You will need to replace any existing integration and marketing assets we have previously provided as they will no longer be legally compliant as of 1st June 2023. You can find the new replacement assets you are permitted to use and the rules that you must follow when using them on the Marketing Resources Centre


For integration and website assets:


  • Check to see if your live integration assets have updated. If you are using our javascript library, they may have automatically updated already. The main integration asses are (you may have a combination of these)


a) Clearpay messaging widget on the product display page

b) Clearpay messaging widget on the cart page during checkout

c) Checkout button

d) Checkout widget


  • If these assets have not been automatically updated, then you are not using our javascript library. This means you must manually update them with those provided in the Marketing Resources Centre and ensure the rules for those assets are adhered to.



  • If you have an FAQ page, update the FAQ’s to match this version. If the page includes ‘How it works’ assets, update to match the asset from the Marketing Resources Centre. Alternatively, remove the page or link directly to Clearpay’s ‘How it Works’ page.



For other marketing channels:


  • Check all scheduled marketing for mentions of Clearpay to be published on 1st June 2023 or after, and update them to only include the appropriate assets and disclaimers from the Marketing Resources Centre.


  • Check your existing lifecycle communications for mentions of Clearpay and update them to use assets from the Marketing Resources Centre.

When do the changes need to be made?

On 1st June 2023, approval for all previous Clearpay marketing language and assets will be withdrawn, making it a criminal offence under the Financial Services and Markets Act 2000 to continue to host or publish financial promotions that use this previous language or assets. Therefore you must update all assets before 1st June 2023.

FAQs

Q: Can Clearpay review my marketing to ensure I've followed the rules properly?


A: No, our support team is not able to review your marketing. It is your responsibility to ensure you comply with the Clearpay UK Marketing Rules. As long as using our assets and follow the rules for their use, your will be compliant with financial promotions requirements


Q: How do I get support to make a technical change to my integration and website assets ?


A: If your assets have not automatically updated, so you are not using our javascript library, visit the Marketing Resource Centre and perform manual update(s) accordingly to ensure adherence to the rules. Reach out to the Clearpay team here should any additional information/assistance be required.


Q: Does my in-store visual media need replacing?


A: As stated in the In-store Media section of the Marketing Resource Centre, you are only permitted to use in-store media provided by Clearpay. If you are using in-store visual media provided by Clearpay or created with our involvement, this remains validly approved and you may continue to use it until you replace it due to wear-and-tear. At this point, you should request new visual media from Clearpay.


If you are using in-store visual media that you have created yourself without Clearpay’s involvement, then you should remove it before the 1st June deadline, and replace it with new visual media from Clearpay.
