Prize Draw Terms and Conditions – Opening Night



• The prize draw (“Prize Draw”) allows one entrantand a guest the chance to win the Prize Draw. To be eligible to win, the entrant and their guest must each be aged 18 years or over. Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.

• The Prize Draw is open to all persons except employees of Clearpay Finance Limited (“Clearpay”), its group companies or their family members, or anyone else connected with the Prize Draw.

• To enter the Prize Draw you must follow the instructions specified in the Clearpay social media post (which is the same as the instructions in the @joycrookes post). By entering the Prize Draw, you confirm that you are eligible to do so and eligible to claim the prize. Clearpay may require you to provide proof that you are eligible to enter the Prize Draw. • There is only one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

• Clearpay accepts no responsibility for entries not successfully completed due to a technical fault of any kind.

• The opening date of the Prize Draw is when the social media post is live, and the closing date of the Prize Draw shall be specified in the social media post (“Promotion Period”). Entries received outside the Promotion Period will not be considered.

• At the end of the Promotion Period, an independent judge will select 1 eligible entrant as the winner who posted the best answer. If you post the same answer as another entrant and if we consider that answer to be the ‘winning’ entry, we will pick the entrant who posted that answer first.

• The winner will receive the prize described in the social media post.

• All expenses and additional costs that are not expressly stated in clause 8 that arise as a result of the Prize Draw are the responsibility of the winner and the winner’s guest. Clearpay will not be responsible for paying any travel or accommodation costs to London.

• The winner and guest are responsible for complying with any COVID-19 requirements set forth by any vendor offering services that are part of the prize. Failure to comply with any vendor COVID-19 requirements, may result in forfeiture of this aspect of the prize. Clearpay shall not provide alternative events that are forfeited through the winner and/or guest’s non-compliance with any COVID-19 requirements.

• The winner will be notified by email 24 hours after the end of the Promotion Period with details of how to accept the prize. If the winner does not respond to Clearpay within 48 hours of being notified by Clearpay to confirm you and your guest’s availability and details, then the winner's prize will be forfeited and Clearpay shall be entitled to select another winner from all remaining eligible entries.

• As part of the prize, Clearpay may take photographs and film the winner and guest at the event . The winner and guest will be asked to agree to Clearpay filming and taking photographs and Clearpay processing the film and photographs for marketing purposes on Clearpay’s website and social media channels.

• The surname and county of the winner can be obtained by entrants after the closing date by emailing [email protected]. If you, as a winner, object to any or all of your surname, county and winning entry being made available to other entrants, please contact Clearpay by email. In such circumstances, Clearpay must still provide the information and winning entry to the Advertising Standards Authority on request.

• The prize is non-exchangeable, non-transferable and is not redeemable for other prizes.

• Clearpay retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.

• The decision of Clearpay regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it.

• Clearpay shall use any personal data you supply to it as described in its privacy policy available at https://www.clearpay.co.uk/en-GB/privacy-policy. Clearpay shall use the personal data with regard to the announcement of the winner and as otherwise stated in these Terms and Conditions.

• Clearpay accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting the prize. Nothing in these Terms and Conditions shall exclude the liability of Clearpay for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence. Your statutory rights are not affected.

• Clearpay reserves the right at any time to modify, cancel, suspend, amend or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control.

• Clearpay reserves the right to refuse entry or to refuse to award the prize to anyone in breach of these Terms and Conditions.

• Clearpay shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control.

• The Prize Draw will be governed by English law and entrants to the Prize Draw submit to the exclusive jurisdiction of the English courts.
