The prize draw ("Prize Draw") is open to all UK customers of Clearpay Finance Limited (“Clearpay” or ‘we”). However, employees of Clearpay, its group companies, their families, agents, contractors or any other party connected or involved with the Prize Draw or the participating prize retailer are not eligible to enter.
Details of how to enter form part of these Terms and Conditions. It is a condition of entry that all rules are accepted as final and entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.
To enter the Prize Draw, entrants must be an existing UK Clearpay customer at the time of entry and go to the link sent via email associated with their Clearpay account to complete the Clearpay customer service survey and follow any and all onscreen instructions to complete and submit the online entry (“Eligible Entry”). No purchase is necessary.
The opening date of the Prize Draw is 9:00 GMT on 2 May 2022 and the closing date of the Prize Draw is 17:00 GMT on 9 May 2022. Entries received outside this time period will not be considered. If you have any questions about how to enter or in connection with the Prize Draw, please e-mail us at [email protected]. Entry is restricted to one per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Once submitted, entries cannot be amended in any way.
Clearpay accepts no responsibility for entries that are incomplete, illegible, corrupt, delayed or not received by Clearpay for whatever reason or for any telecommunication or internet faults, failures or delays or telecommunication network incompatibility. Only complete and clearly legible entries will be entered into the Prize Draw.
One winner will be chosen from a random draw of Eligible Entries received in accordance with these Terms and Conditions by an independent representative of Clearpay or its group companies. The draw will take place on or about 13 May 2022.
Four winners will each receive a £150 gift voucher to be chosen in Clearpay’s sole discretion. Where the prize is a voucher, this is subject to the retailer’s terms and conditions displayed on the voucher.
The winners will be notified by email within 7 days of the Prize Draw. If the winner does not respond to Clearpay within 7 days of being notified by Clearpay or if the prize notification or prize is returned as unclaimed or undeliverable to such winner, then the winner's prize will be forfeited and Clearpay shall be entitled to select an alternative winner in accordance with the process described above (and that winner will have to respond to accordingly as detailed above or else they will also forfeit their prize).
The surname and county of the winners can be obtained by entrants after 13 May 2022 by emailing [email protected]. If you, as a winner, object to any or all of your surname, county and winning entry being made available to other entrants, please contact Clearpay by email. In such circumstances, Clearpay must still provide the information and winning entry to the Advertising Standards Authority on request.
The prize is non-exchangeable, non-transferable and is not redeemable for cash or other prizes. Should a prize become unavailable, a substitute prize of equal value shall be provided by Clearpay.
The decision of Clearpay regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it.
Clearpay shall use any personal data you supply to it as described in its privacy policy available at https://www.clearpay.co.uk/en-GB/privacy-policy. Clearpay shall use the personal data with regard to the announcement of the winner and as otherwise stated in these Terms and Conditions.
Clearpay accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting the prize. Nothing in these Terms and Conditions shall exclude the liability of Clearpay for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence. Your statutory rights are not affected.
Clearpay reserves the right at any time to modify, cancel, suspend, amend or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control and the entrant agrees that no liability shall attach to Clearpay as a result.
Clearpay shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include but not be limited to weather conditions, fire, flood, strike, industrial dispute, war, pandemics or epidemics, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to a force majeure event.
If there is any reason to believe that there has been a breach of these Terms and Conditions or fraud, we may, at our discretion, exclude entrants from participation in the Prize Draw.
The Prize Draw will be governed by the law of England and Wales and entrants to the Prize Draw submit to the exclusive jurisdiction of the courts of England and Wales.
